Other than the fact that it restrains Tom from posting about the subject on the Internet (which is a violation of the First Amendment) the write up is enlightening to see what transpired in the famous blood incident from Linda Woolard's standpoint. I for one don't think that Tom has been honest about this incident and I would like to see a comparison between what Ms. Woolard states and Tom's several versions of this incident. The case was filed in Los Angeles Superior Court on November 21, 1995. TOM THEO KLEMESRUD ATTACHMENT TO PETITION FOR INJUNCTION PROHIBITING HARASSMENT 4. The plaintiff is 50 years of age. Her children are grown and reside in Nevada. She has been divorced for over 20 years and currently resides in a studio apartment in Burbank, California with her boyfriend, Barry Rohrbach. Mr. Rohrbach provides the plaintiff with her sole means of support. Mr. Rohrbach works in Burbank as an aircraft mechanic on the night shift, usually between the hours of 8:00 pm and 4:00 am. The plaintiff does not drive and uses a California Identification card for identification. On January 14, 1995, the plaintiff by herself took a cab to the Cinnamon Cinder bar at 4311 W. Magnolia Boulevard in Burbank. After sitting at the bar for a brief time, a man sitting close by struck up a conversation with her. The man is the Defendant, Tom Theo Klemesrud, 45 years of age. This is the first time the Plaintiff ever met the Defendant. She had never heard his name before and had no idea who he was or where he lived. The Defendant purchased alcoholic drinks for himself and the Plaintiff. The Defendant told the Plaintiff about how he was into computers and even had a network of children he corresponded with on the Internet. The plaintiff concluded the Defendant worked with children and this made the Plaintiff comfortable talking with him. The Defendant appeared to be a regular at the bar as he knew the bartender and several patrons who he introduced her to. After a while, the Defendant told the Plaintiff that he was going to go to a different bar where he had a lot of friends and invited the Plaintiff to accompany him. The plaintiff agreed and they went by taxi to The Casting Office at 3256 Cahuenga Boulevard West, Hollywood. The Defendant paid for the taxi ride. The defendant continued drinking alcoholic beverages at The Casting Office while the Plaintiff switched to drinking ice water. Sometime after 9:00PM, the Defendant and Plaintiff decided to leave the bar and go to their respective residences. Because he had been drinking, the Defendant asked the Plaintiff if she would ride with him in a taxi to his apartment in North Hollywood to make sure he made it home safely. The Plaintiff told him that she didn't have enough money to pay for the taxi to get home from North Hollywood. He told her that he would pay the taxi to take her home once he arrived safely. Once the Plaintiff and the Defendant arrived in front of his apartment, the Defendant convinced the Plaintiff to accompany him to his apartment. After entering the apartment the Defendant showed the Plaintiff his guitar and computer equipment. The defendant then asked the Plaintiff to come into his bedroom, once inside the bedroom, the defendant picked up a shotgun and proceeded to load it. He started acting crazy and accused the plaintiff of being from the CIA and the IRS and then told her that if she didn't "fuck" him that she would never leave the apartment alive. The plaintiff was terrified. The Defendant held the shotgun to her head and told her he could kill anyone he wanted, including the Plaintiff. He also told her he could kill himself. The Plaintiff had a pre-existing medical condition which causes her hemorrhoids to bleed when under stress or when drinking heavily. She started hemorrhaging from her rectum and tried to calm the Defendant. She explained her medical condition to him. She went into the bathroom and removed her denim pants which were soaked with blood. She wrapped herself in a towel. The Plaintiff was very scared of the Defendant who continued acting crazy and threatening. The Defendant kept pointing the shotgun at her and physically assaulted her by pushing her around his apartment. The Plaintiff thought the Defendant was going to rape her, kill her or even commit suicide. The Defendant then said that he knew about the Church of Scientology and knew that the Church sent people out. He began accusing the Plaintiff of being from the Church of Scientology. She had no idea what the Defendant was talking about. She had never been to a Church of Scientology, didn't know any of its members and hadn't been sent by anyone to meet the Defendant. The Defendant kept threatening her and shoving her around. This caused the Plaintiff to suffer more emotional distress which caused more bleeding from her rectum and caused blood to be spread around the room. The Defendant told the Plaintiff that she could not go into the bathroom unless he was allowed to watch her. Plaintiff became more terrified and thought she would never leave the apartment alive. The Defendant refused to let the Plaintiff leave the apartment. The Defendant kept making phone calls and said he was calling the Church of Scientology, the FBI and the police. However at that time, Plaintiff did not know who the Defendant was talking to. The Plaintiff was able to calm him down a little. About an hour later Plaintiff was able to dial 911 but the Defendant hung up the phone. Shortly thereafter, at 22:45 hours, the Plaintiff was able to dial 911 and get through. Shortly thereafter two uniformed LAPD officers arrived. The Plaintiff told them what happened. The Defendant lied to the police and told them that the first time he ever met the Plaintiff was that evening when she knocked at his door and told him she was an IRS Agent. The Defendant lied and told the Police that he let her in his apartment and she went into his bathroom and began cutting herself. He lied and told the police that the Plaintiff was trying to frame him because he is critic of the Church of Scientology. The Defendant told the police that he was an FBI Informant and that people like the Plaintiff were always trying to frame him. The Defendant further lied when he denied pointing his shotgun at her and physically assaulting her. The Defendant kept making false statements to the police officer and acted like he was mentally unbalanced. The police officers completed their investigation and seized the Defendant's loaded shotgun. At about 11:30 pm, the police officers arrested the Defendant for felony PC 245 (a)(2) Assault With a Deadly Weapon. He was subsequently booked and his bail was set at $30,000. The Plaintiff was neither detained nor taken to the police station. She left the defendants apartment, phoned Mr. Rohrbach at work to get a ride home. Since the night of the Defendant's arrest, the Plaintiff has never been contacted in person, by telephone or in writing, by anyone from the LAPD or District Attorney's Office concerning the incident. On March 30, 1995, the Plaintiff made a written request for a copy of Defendant's arrest report and subsequently obtained a copy from the LAPD. The report incorrectly lists her phone number as 848-5413 instead of 848-4135. Although the arrest report contains the Plaintiff's correct address, the police officers omitted the letter "C" of her apartment from her address. Because of the incorrect phone number and missing apartment letter, the investigating detective was apparently unable to reach the Plaintiff and the charges against the Defendant were dropped. The Plaintiff has also obtained an audio tape copy of two telephone calls made to 911 from the Defendant's apartment on the night of the incident. The first was placed by the Defendant and the second by the Plaintiff. DEFENDANT'S CALL The 911 tape of the Defendant's phone call to LAPD begins at 21:43 hours. The tape goes as follows: LAPD: "911 emergency operator 434." DEFENDANT: "Yea, I have, ah, I'm a , I'm a anti-member of the Church of Scientology and I have a Scientology member in my apartment building who bleed all over my bathroom and she's alive and she's fine. LAPD: "You need the paramedics? DEFENDANT: "No, not at all. No we don't even need the police." LAPD: "Okay. What's the problem then sir?" DEFENDANT: "Ah, we have a scientologist going after an anti-Scientologist and if you don't understand that you can call the FBI." LAPD: "But why do you need the police? Why are you calling 911?" DEFENDANT: "Because the FBI told me to call." LAPD: "Who called - told you to call?" DEFENDANT: "Three, ah, the FBI. You understand their number - 6565?" LAPD: "Well, why did they tell you to call?" DEFENDANT: "Because you have...then she said why did they tell me to call. I'm sitting here with a rabid Scientologist infiltrating my apartment and the FBI told me to call and I'm calling. Okay? And this isn't funny. It's not funny. Okay? LAPD: "I'm not laughing." DEFENDANT: "I want you to call the FBI and find this out real quick. Okay? And she's got a lot of blood in my bathroom floor, you know, hemorrhaging from woman-female things and she's going to blame that on me. Okay?" LAPD: "So you want me to call the FBI?" DEFENDANT: "Absolutely - yes." LAPD: "Why don't you call the FBI?" DEFENDANT: "I already did." LAPD: "But why do you want me to call?" DEFENDANT: "So you know the story. They told me to call you. LAPD: "I don't see how I can help you sir. Do you need the paramedics? Yes or no?" DEFENDANT: "No, I need the FBI. There's a federal crime - there's been a federal crime committed here. Okay, as a matter of fact I'm going to stay on the...as a matter of fact I'm reporting a federal crime and it is money laundering. Miss, the crime is money laundering." LAPD: "Who's doing that?" DEFENDANT: "The lady in my apartment right now. You call him and I'm going to stay on the line you asshole! So call him right now!" LAPD: "One moment sir. I'm going to put you on hold." (LAPD operator is talking to someone at her location: "Excuse me. Excuse me. Could you look up the special loop for 5143 Bakman? What does that mean? What does that tell me? I have this address on the line and he's talking about the FBI and it sounds like a 5150." [Note: 5150 is police jargon for Welfare and Institution Code Section 5150 which deals with mentally disturbed individuals.] "Okay. Okay. Thank you.") DEFENDANT: "Hello sir, is this the FBI?" LAPD: "No it isn't. What I'm going to do is transfer you to my supervisor..." DEFENDANT: "And, and she's squirreling, meaning, meaning that ah, she, she doesn't go along with, with, with the church's orders." LAPD: "Stay on the line on moment sir. I'm going to transfer you to my supervisor. BUSY SIGNAL.........(LAPD operator unsuccessful in transferring call to her supervisor." The call ends at 21:49 hours. PLAINTIFF'S CALL The 911 call to the Fire Department placed by the Plaintiff begins at 22:45 hours. It goes as follows: LAFD: "911 emergency 585." PLAINTIFF: "Yes. A man has gone out of his mind and I have no clue what to do with him." LAFD: "Who is this man, ma'am? DEFENDANT: "The guy who owns the telephone who has called the FBI already. This is the Church of Scientology." LAFD: "Sir, sir, would you put the lady on the phone." DEFENDANT: "Yes I will. He wants to talk to you." LAFD: "Okay, ma'am?" DEFENDANT: "This is the Church of Scientology who is trying to frame me." LAFD: "Sir - sir..." DEFENDANT: "Here is the lady..." LAFD: "Sir, sir, get off the phone sir!" DEFENDANT: "The FB......here is the lady." PLAINTIFF: "Hello." LAFD: "Okay ma'am, what is this man doing to you? This man that's right there. The one I just talked to. PLAINTIFF: "The one that put a 12 gauge to your head. The one that says you can't go to the bathroom because you're hemorrhaging." LAFD: "Stay on the line. Let me transfer you to the police operator so they can switch you to the police. PLAINTIFF: "Thank you." LAPD: Los Angeles Police Department..." PLAINTIFF: "I need some kind of help here." LAPD: "What's the problem?" PLAINTIFF: "This man's paranoid. I don't know. He won't allow me to go to the bathroom. LAPD: "Who are you talking about?" PLAINTIFF: "I'm hemorrhaging right now.......12 gauge and moved it up and said, 'don't worry about shooting me if you want to'....I think perhaps you ought to come over.....I don't know what to do about this situation. I really don't know what to do. LAPD: "What is the address?" PLAINTIFF: "I'm sorry, I have no clue right now...I'm hemorrhaging. LAPD: "You don't live there?" PLAINTIFF: "No I don't." LAPD: "How did you get there? Hold on for the paramedics." DEFENDANT: "Yes, miss? LAPD: "Yes." DEFENDANT: "Yea you're going to have to....." LAFD: "Paramedics 405. May I help you?" (Note: LAPD and LAFD are both on the line) LAPD: "What did you say?" DEFENDANT: "You're going to get a better, ah...you're going to get a better ah...shit. This is the Church of Scientology trying to set up somebody who is a critic...that's what this is...okay?" LAFD: "He's a what?" DEFENDANT: "This is the Church of Scientology trying to set up a critic." LAPD to LAFD: "The lady said she was hemorrhaging so I transferred to you...I don't know what..." DEFENDANT: "I don't think she's hemorrhaging, but, you know, if she's hemorrhaging she did it herself. See I don't know women does that." LAPD: "What's wrong with you?" DEFENDANT: "Huh?" LAPD: "What's wrong with you?" DEFENDANT: "I've had...I've had a few drinks...that's all that's wrong with me. LAPD: "Is it your girlfriend?" DEFENDANT: No. Absolutely not. She met me at the bar. You've got to call the FBI. The FBI understands. Okay? LAFD: "You're calling from your own apartment?" DEFENDANT: "Yea, and I have friends at the FBI and they know my name. You know my name." LAFD: "I thought you said this was the Church of Scientology." DEFENDANT: "Absolutely...yea...this...yes it is and she has the ability to train my shotgun on me and shoot me but she won't do that." LAFD: "Hold on a second...hold on a second..." DEFENDANT: "If the police come there's no threatening situation..." LAFD: "Hold on one second please. Okay PD are you going to handle?" LAPD: "Yea, we got it. Bye." The call ended at 22:49 hours. Shortly thereafter, based on the Plaintiff's call to 911, the police came and arrested the defendant as previously described. Since the night of the incident and continuing to the present, the Plaintiff has received numerous hang up and annoying telephone calls and has been followed and spied upon. She has received phone calls from persons she has never met asking her to discuss the incident. She feels that the Defendant is doing this and is directing others to harass her. She is afraid to leave her apartment unless accompanied by others, especially after dark. On the evening of May 27, 1995 the Plaintiff and some female friends walked to the Whiskey Bend bar on San Fernando Road in Burbank. This bar is located two blocks from the Plaintiff's residence. Near closing time, the Plaintiff observed that the Defendant was inside the bar and was watching her. She became terrified and ran into the women's bathroom to get away from him. She immediately began hemorrhaging from her rectum because of the emotional distress she was once again experiencing by being in the vicinity of the Defendant. When her friends went into the bathroom to see what was wrong they found her bleeding profusely. They phoned for an ambulance. She was transported and treated in the emergency room at Thompson Memorial Medical Center in Burbank. Later at about 6:00 am on May 28, 1995 she was transferred by ambulance to Olive View - UCLA Medical Center in Sylmar for further emergency treatment. She was released later in that afternoon. The plaintiff has no medical insurance and no income and cannot afford to be treated by medical doctors. Since the night of the incident and continuing to the present, the Defendant has continued to harass and annoy the Plaintiff by placing numerous defamatory and false derogatory written messages about the Plaintiff on the worldwide Internet computer system. These messages are placed into an anti-Church of Scientology Internet newsgroup found at "alt.religion.scientology," which tens of thousands of people use. Anyone in the world having access to the Internet can read and respond to the Defendant's postings. As a result of Defendant's defamatory written postings, others on the Internet have also harassed and annoyed the Plaintiff by making similar postings and by contacting the Plaintiff and her sister, Mrs. Teri Bermudez, by telephone. The plaintiff's name, address, phone number and physical description have been placed on the Internet in this manner. The Plaintiff is fearful that the Defendant, or some other kook on the Internet, may come to her residence and attack her as a result of the false and malicious Internet postings about her. Included are quotes of postings to the Internet. One batch is from the Defendant and the other is from various other persons. The first Internet posting about the Plaintiff occurred just hours after the Defendant was booked on January 15, 1995. It was posted by Dennis Erlich, an associate of the Defendant, who happens to live close the Plaintiff. Mr. Erlich wrote that the Defendant "was framed for assault with a deadly weapon by a female Scientology agent who befriended him in a bar and got him to let her into his house." The posting goes on to say that Plaintiff spread blood from an unknown source around the bathroom and that she admitted to the Defendant she was from the church. The posting also said that the Defendant called the police when he realized he was being set up and, based on her falsely claiming he pointed a shotgun at her, arrested him for assault with a deadly weapon. The Defendant made an Internet posting about the Plaintiff on January 21, 1995. Although the tape recording of the Defendant's telephone call to the police on January 14, 1995 had him telling the 911 operator that the Plaintiff was hemorrhaging from "woman-female things" he posted the following: "...In fact, the blood came from a bag, bladder, or balloon nestled in her crotch. I saw it. If this is a medical problem, then she has an intestine or artery running outside her body filled with cold almost coagulated blood." In another Internet posting the Defendant made on January 26, 1995 he libeled the Plaintiff when he wrote: "Miss Blood got access to the internet site (his apartment) by claiming to be an IRS CID agent...I sat down a light colored dinette chair for her to sit on. There were no stains on that chair after she sat on it--I have witnesses. So, she was not bleeding-soaking before she went into the bathroom. She excused herself to the bathroom. She took some time, so I checked on her to find much blood smeared all over the bathroom: On the floor, walls, shower doors, but little in the toilet. After I had discovered her she came out of the bathroom and said: 'I am from the Church of Scientology, and I think that you should do as Thomas Small has instructed you to do--delete Dennis Erlich from the BBS.'...she also said 'I have been sent on a mission, and I have been told to put blood in various places in your house..." Defendant made an Internet posting on March 9, 1995 which indicated the Plaintiff's sister had been contacted by a reporter: "...Miss Blood's sister revealed to a newspaper reporter Miss Blood has no medical problems. The Defendant identified the Plaintiff by her full name in numerous Internet postings such as the one he posted on June 8, 1995: "...It is clear from the beginning of the call that I placed the call, not Linda Lee Woolard..." The Defendant falsely and maliciously accused the Plaintiff of committing a felony in his Internet posting of June 10, 1995 when he wrote: "...Linda Lee Woolard...Earlier in the evening Miss Woolard committed a Federal Felony by impersonating an IRS agent. She showed me false identification to that effect, and asked to see my BBS. When in the apartment, she proceeded to smear a blood-like substance all over my apartment." On October 8, 1995 the Defendant made another Internet posting which read in part: "...On January 14, 1995...I was befriended in a bar after returning from a conference in Denver. Later, this woman impersonated an IRS agent...I saw that she had spread blood all over the floor and walls in the bathroom...Then she returned to the bathroom to rupture a tube-like bag of blood she had nestled in her crotch. She re-emerged to spread blood in other parts of my dwelling saying, 'I am on a mission, and I have been sent here to spread some blood..." In an October 29, 1995 Internet posting the Defendant additional false and malicious statements. The plaintiff has never seen or possessed IRS identification or known any IRS agents. The Defendant wrote in part: "...I personally know IRS Criminal Investigation Division Special Agents. Woolard started name dropping, and showed IRS ID, in order to convince me she was from IRS CID, and worked with, and knew my friends as IRS CID..." Attached are Internet postings from others who have responded to the Defendant's false accusations against me. They begin January 15, 1995 and continue until October 30, 1995. Some of the postings are from James J. Lippard. This is the same James Lippard who obtained the Plaintiff's telephone number and phoned the Plaintiff around August 1, 1995. He told her he was a writer from Phoenix, Arizona and had written and already published a magazine article about the incident involving the Defendant in "Skeptic" magazine. He then mailed the Plaintiff the magazine dated Volume 3, Number 3, 1995. The magazine arrived via US Priority Mail at her residence address. It was postmarked August 1, 1995. The article was titled "The 'Miss Blood' Incident" and contained most of the Defendant's previously mentioned false and malicious statements about the January 14, 1995 incident. During the evening of November 16, 1995, the Plaintiff looked out her window and observed the Defendant standing across the street staring in the direction of her apartment. He was stalking her. This frightened the Plaintiff, especially because she is usually home alone from 8:00 pm until 4:00 am. In addition, it was learned that the Defendant had directed an agent of his, a man named Pierre Merkl, to surveil and follow the Plaintiff and to contact her family to obtain information about her. As described above, prior to this incident the Plaintiff had never been a member of the Church of Scientology, had never known any of its members and had never taken any directions from it. She never told anyone, including the Defendant that she was from the Church of Scientology or any such thing. She has never been a CIA, IRS or FBI agent, or a Scientologist and has never possessed any such false identification from any of these organizations. She has never told anyone that she was any kind of federal agent. The Defendant's felonious attack upon the Plaintiff, his subsequent stalking of her on at least two occasions, his agent/ Pierre Merkl following and surveillance of her and the Plaintiff's subsequent false and malicious attack upon her on the Internet has caused her, and continues to cause her, severe emotional distress and fear for her life, and the lives of Barry Rohrbach and her sister, Mrs. Teri Bermudez. end
